If the brand has recognition, a customer base, a website, while not having a trademark in the United States, the possibility of registering this brand as your own trademark is reduced to zero.

Judicial practice calls this a "Free Ride" - an action performed by a competitor with the intention of using the commercial achievements of another person for their own purposes.

A good example of "Free Ride" is the dispute between the American company Belmora and the Mexican company Bayer, for the identical trademark FLANAX.

The American company was a distributor and decided to get a TM in the States. Bayer was only registered in Mexico, but was famous in the USA. The case has reached the district court and is now at the stage of revoking the registration of an American company's trademark.
